Who can order
You must be 18 or older and have a shipping address in Canada. We do not ship outside Canada.
Prices and payment
All prices are in Canadian dollars. Applicable GST or HST is added at checkout based on your shipping address. Payment is processed securely by Helcim; we never see or store your full card number.
Prices can change without notice, and many of our products are imported, so a listed price can be wrong: a typing error, a currency-conversion error, a supplier price change that has not reached the site yet, or a system fault. We are not obligated to sell at an incorrect price. If we find a pricing error on an item you have ordered, even after you receive a confirmation email, we will contact you and either offer the item at the correct price, which you are free to accept or decline, or cancel the affected item and refund it in full. A refund is the only remedy for a pricing error.
Your order
Placing an order is an offer to buy. When you place one you will get a confirmation email; that confirms we received the order, not that we have accepted it. We accept your order only when we ship it. Until then we may decline or cancel all or part of any order at our discretion, including because a product is unavailable, discontinued or out of stock, because of a pricing or product-listing error, because we cannot verify payment or a shipping address, or where we suspect fraud or resale. If we cancel, we refund everything you paid for the cancelled items and let you know why. Our liability for a declined or cancelled order is limited to that refund.
Availability
A product appearing on the site is not a guarantee that it is in stock or still made. Most of what we sell ships from the manufacturer or distributor, and their stock and model line-ups change without notice. If an item becomes unavailable after you order, we will tell you as soon as we know and either offer a substitute, a delay, or a full refund for that item; the choice is yours. We are not liable for any loss caused by an item being unavailable or delayed.
Shipping
Shipping is charged per item and shown on each product page and at checkout. Some large items (turf and hitting mats) are quoted after checkout: we email you a quote to approve before any shipping is charged, and you may cancel for a full refund if you do not accept it. Every product page shows where the item ships from and what shipping costs: free shipping within Canada, a per-item fee added at checkout, or a freight quote after checkout. Many items ship directly from the manufacturer or its distributor, in Canada or abroad. Where an item ships from outside Canada, duties and brokerage are included in the price, so there is nothing extra to pay on delivery. Risk of loss passes to you when the carrier delivers to your address.
Returns and refunds
Our Returns & Refunds policy is part of these terms. Impact screens, turf, flooring, hitting mats, anything cut to size or made to measure, custom orders and opened software are final sale.
Custom and made-to-measure items
Custom and made-to-measure items are built for you once your order is confirmed. They cannot be changed or cancelled once production starts, and they cannot be returned. Measurements you provide are your responsibility; we will confirm them with you before production.
Warranty
Products are covered by the manufacturer’s warranty only. Swing Depot does not add its own warranty, but we will help you get in touch with the manufacturer and support a claim where we can.
Software and subscriptions
Simulator software, subscriptions and apps sold with or for our products are governed by the manufacturer’s own licence terms, not by us.
Product information
Descriptions, images, specifications and prices come largely from the manufacturers. We do our best to keep them accurate, but details may change, images may differ from the product you receive, and errors happen. We may correct any error at any time, and an error on the site does not oblige us to sell an item as described or priced.
Limitation of liability
To the fullest extent the law allows, our total liability for any order is limited to the amount you paid for it. We are not liable for indirect losses such as lost use, lost profit or the cost of installation work. Nothing in these terms limits rights you have under Ontario consumer protection law.
Governing law
These terms are governed by the laws of Ontario and Canada. Any dispute will be dealt with in the courts of Ontario.
Changes
We may update these terms at any time. The version in effect when you place an order is the one that applies to it.
